Terms & Conditions
Effective date: 20-July-2026
1. Overview
www.aerloft.com, including its content, features, tools, products and services (together, the "Services"), is operated by Aerloft Collective, LLC, a limited liability company formed in Wyoming, United States, trading as AERLOFT ("we", "us", "our"). The store is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service ("Terms"), together with the policies they incorporate — our Shipping Policy, Returns & Exchanges Policy, and Privacy Policy — describe your rights and responsibilities when you use the Services. Please read them before ordering: they include important information about your legal rights, including warranty disclaimers and limits on liability. By using the Services or placing an order, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, please do not use the Services.
2. Eligibility And Your Information
You must be at least 18 years old to use the Services and to place an order. When you place an order or create an account, you agree to provide information that is correct, current and complete, and to keep it up to date so that we can fulfil your orders and contact you when needed. You are responsible for keeping any account credentials secure and for activity under your account, and you may not transfer, sell or assign your account to anyone else.
3. The Products
Every product sold on the Services is a fine art print of an original work by a living artist, produced individually for the order that purchases it. Minor variations between individual prints, and between a print and its on-screen image, are inherent to the product and are not defects. Colours may differ from what your screen shows depending on your device and its settings. Product dimensions refer to the printed image; framed pieces measure slightly larger, as described on each product page. Product descriptions may change over time, and we may discontinue any product or limit quantities at our discretion.
4. Orders And Acceptance
An order placed through the Services is an offer to purchase. Our order confirmation email acknowledges receipt of your offer; a contract is formed when the order is dispatched. We may decline or cancel an order before dispatch, including where a pricing or listing error has occurred, where payment cannot be received or verified, where fraud is suspected, or where the delivery address cannot be served. If we decline or cancel an order you have paid for, we will notify you using the contact details provided with the order and refund it in full, promptly, to the original payment method. Because production begins quickly, changes and cancellations by you are possible only before a piece enters production, as set out in the Returns & Exchanges Policy. Purchases are for your personal or household use, not for commercial resale.
5. Prices And Payment
All prices are in US dollars and include shipping within the United States. Sales tax is added at checkout where a state requires it. Prices may change over time; the price charged is the price in effect when you place your order, as set out in your order confirmation. Payment is taken at the time of order through the payment methods offered at checkout. Payments are handled by our payment processors, and we do not receive or store full bank or card details. By providing a payment method, you confirm that you are authorised to use it and that the charges you incur will be honoured. If a product is listed at a materially incorrect price as the result of an error, section 4 applies.
6. Shipping And Delivery
Shipping is governed by our Shipping Policy, which forms part of these Terms. We currently ship within the United States only. Delivery timeframes shown on the Services are good-faith estimates rather than guarantees, and we are not responsible for delays caused by carriers or events outside our control; where a parcel is confirmed lost in transit, the remedies in the Shipping Policy apply. Responsibility for a piece passes to you on delivery to the address provided at checkout.
7. Returns, Damage And Refunds
Our Returns & Exchanges Policy forms part of these Terms. In summary: because every piece is produced individually for the order that purchases it, returns and exchanges are not accepted for change of mind; pieces that arrive damaged or defective are replaced or, where a replacement is not possible, refunded in full, provided the problem is reported within 30 days of delivery with photographs of the piece and its packaging. Nothing in these Terms or that policy limits rights you have under applicable law in respect of goods that arrive faulty or not as described.
8. Intellectual Property In The Artwork
Every artwork sold on the Services is an original work created by a human artist. The copyright in each artwork is owned by the artist or licensed to us; no copyright or other intellectual property right transfers with the purchase of a print. What you acquire is the physical print itself. You may display, move, gift, or resell that physical piece. You may not reproduce the artwork in any form or medium, including by scanning or photographing it to make new copies; distribute or communicate copies to the public; create derivative works from it; use it commercially, including in products, packaging, publications, or advertising; or remove or obscure any artist credit. The same restrictions apply to the digital images of the artworks displayed on the Services.
9. Intellectual Property In The Services
The Services — including text, layout, photography, images, graphics, logos, and the design, selection and arrangement of all of it — are owned by us or our licensors and protected by copyright, trademark and other intellectual property laws. These Terms permit you to use the Services for personal, non-commercial purposes: browsing, sharing links, and quoting short passages with attribution. You may not otherwise reproduce, distribute, modify, republish, store or exploit the Services' content without our prior written consent. The AERLOFT name, logo and marks are our trademarks and may not be used without our permission; Shopify's name and marks are trademarks of Shopify; all other marks belong to their respective owners. All rights not expressly granted are reserved.
10. Reviews And Feedback
If you submit reviews, comments, suggestions, or other content to the Services ("Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute and display that Feedback in any medium, for any purpose, including commercially — for example, showing your product review on a product page. You confirm that the Feedback is yours to give, is accurate, discloses any compensation or incentive you received in connection with it, and does not infringe anyone's rights or contain anything unlawful, defamatory, or malicious (including any virus or other harmful code). You may not use a false email address or impersonate anyone in connection with Feedback. We are under no obligation to keep Feedback confidential, to pay for it, or to respond to it, and we may monitor, edit or remove Feedback that we determine violates these Terms.
11. Acceptable Use
You may use the Services for lawful purposes only. You must not use them, directly or indirectly: to violate any law or regulation; to infringe our intellectual property rights or anyone else's; to transmit false or misleading information, spam, viruses, or any other malicious code; to impersonate any person or entity; to harass, abuse, defame, or harm anyone; to collect or track the personal information of others; to scrape, copy, duplicate, resell or exploit any portion of the Services; or to interfere with, bypass, probe or circumvent the Services' security or access-control measures. We may suspend, disable, or terminate access at any time, without notice, if we determine these Terms have been violated.
12. Automated Access And AI Agents
This section applies if any software or service that takes autonomous or semi-autonomous action on behalf of a person or entity (an "Agent") accesses, uses, or interacts with the Services. Agents must, at all times: identify themselves as Agents and disclose their name in the user-agent string of every request (in the form "Agent/[agent name]"); refrain from concealing or obfuscating that access comes from an Agent, including by mimicking human behaviour or completing or circumventing CAPTCHAs or other measures intended to distinguish humans from software; respond truthfully to any prompt asking whether an interaction comes from a human; and refrain from circumventing any measure that blocks, limits, or controls Agent access. We may limit, including by technical measures, whether and how Agents access the Services, and no Agent may access the Services after we have asked it not to.
13. Third-Party Links And Tools
The Services may contain links to third-party websites and may provide access to optional third-party tools. These are provided as a convenience, "as is" and "as available", without endorsement, and we do not monitor or control them. We are not responsible for their content, accuracy, security, or policies, and any use of them is at your own discretion and risk — please review the relevant third party's terms before engaging. Complaints or questions about third-party products and services should be directed to the third party.
14. Relationship With Shopify
AERLOFT is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Aerloft Collective, LLC. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and us, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with us. Certain personal information is also processed by Shopify as described in our Privacy Policy and in Shopify's own privacy policy.
15. Errors, Inaccuracies And Omissions
Occasionally, information on the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, availability, or transit times. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice, including after an order has been submitted, in which case section 4 governs any resulting cancellation and refund.
16. Disclaimer Of Warranties
The information presented on the Services is made available for general information. TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT REPRESENTATIONS, WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE AND NON-INFRINGEMENT, AND WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. SOME JURISDICTIONS LIMIT OR DO NOT ALLOW SUCH DISCLAIMERS, SO THIS SECTION MAY NOT APPLY TO YOU. Nothing in this section limits the product remedies in section 7 or any rights that cannot be disclaimed under applicable law.
17. Limitation Of Liability
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or for death or personal injury caused by negligence. SUBJECT TO THAT, TO THE FULLEST EXTENT PERMITTED BY LAW: NEITHER AERLOFT COLLECTIVE, LLC NOR ITS OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, NOR SHOPIFY OR ITS AFFILIATES, WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA OR REPLACEMENT COSTS, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY; AND OUR TOTAL LIABILITY IN CONNECTION WITH ANY ORDER IS LIMITED TO THE AMOUNT YOU PAID FOR THAT ORDER.
18. Indemnification
If your breach of these Terms or the policies they incorporate, your violation of any law or of a third party's rights, or your misuse of the Services gives rise to a claim by a third party against us, Shopify, or our respective affiliates, officers, employees, agents, contractors, licensors or service providers, you agree to indemnify, defend and hold the affected parties harmless from the resulting losses, damages, liabilities and reasonable costs, including legal fees. We will notify you of any such claim and may control its defence and settlement; you agree to cooperate in the defence, and we will not settle a claim that imposes non-monetary obligations on you without your consent, which may not be unreasonably withheld.
19. Termination
You may stop using the Services at any time. We may suspend or terminate your access to the Services (or any part of them) where these Terms are violated or where the law requires, and you remain responsible for amounts due up to and including the date of termination. Sections that by their nature should survive termination — including sections 8, 9, 10, 14, 16, 17, 18 and 20 — survive it.
20. Governing Law And Disputes
These Terms, and any order placed under them, are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law rules. In the event of a dispute, please contact us first at support@aerloft.com; most matters can be resolved directly. Any dispute that cannot be resolved informally will be subject to the jurisdiction of the state and federal courts located in Wyoming, and both parties submit to that jurisdiction. Where the law of your place of residence grants protections or venue rights that cannot be waived, those rights are unaffected.
21. Changes To These Terms
The current version of these Terms is always available on this page. We may update, change or replace any part of these Terms by posting updates here; we will notify you of material changes as required by applicable law, and changes take effect on the date stated in the notice or, otherwise, on posting. The version published at the time you place an order applies to that order, and your continued use of the Services after changes are posted constitutes acceptance of them.
22. General
If any provision of these Terms is found unlawful or unenforceable, it will be enforced to the fullest extent permitted and severed to the extent it cannot be, without affecting the remaining provisions. A failure by us to enforce any provision is not a waiver of it. These Terms, together with the policies they incorporate, are the entire agreement between you and us regarding the Services and supersede any prior agreements or communications on the subject; ambiguities are not to be construed against the drafting party. You may not assign or transfer your rights or obligations under these Terms without our prior written consent; we may assign ours without consent, including to a successor of the business, on the same terms. Headings are for convenience only.
